Abstract

In this investigation, we intend to comprehend the ways in which the personal and social characteristics of the adolescent involved in violent situations can interfere in the application of a juvenile penal sanction. Utilizing the deductive method, we proceed to a critical analysis of the contact points between the spaces of judicial subjectivity in the application of the sanctions and the mechanisms of criminal control. With this study, we understand that the possibility of considerations about the adolescent’s individual conditions allows judicial decisions that can utilize social markers viewed as risks to be contained through the juvenile responsabilization system.
