The perspective of intersectionality in the analysis of gender cases in the Inter-american Human Rights System

Abstract

It analyzes the role of intersectionality in the field of gender studies and its importance for a better understanding of the multiple relationships involved with inequality. It highlights, as a theoretical reference, the intersectional thinking of Kimberlé Crenshare, under the decolonial feminist vision of Françoise Vergès, as epistemological vectors capable of structuring the best conceptual version of Human Rights. It reflectively examines, using the hypothetical-deductive method, gender judgments selected in the Inter-American System of Human Rights to demarcate the presence or not of the intersectional element in its recommendations or sentences, pointing to the need to deepen the understanding and consideration of the overlapping of multiple oppressions and existing discrimination.
