Social death, Covd-19, and human rights : an international treaty to face pandemics

Abstract

The risk of relativizing human rights in a pandemic, with the adoption of restrictive public policies and emergency measures, motivated this work, which has, as its main objective, to address the contribution of the Inter-American System in the preservation of human rights in the face of the state of exception experienced by the international community. The specific objective of the paper, in turn, is to establish the relationship between mistanasia, social death, with Covid-19 and human rights, and to reflect on whether an International Treaty for Future Pandemics would be effective in ensuring social justice. The article will address the relationship between social misthandling and Covid-19 in order to go into the analysis of the documents adopted by the organs of the Inter-American System, and will address how the theory of the Anthropocene, which considers man as the holder of the earth's natural resources, relates to the pandemic and to human rights in order to reflect on the effectiveness of such an International Treaty. In this sense, we conclude that the prevalence of human rights, in times of exception, and the need for harmonization between anthropocentrism and ecocentrism are necessary positions for the pandemic and post-pandemic periods, which justifies the relevance and importance of the theme, developed in the context of the pandemic, and reveals the originality of the approach, under the bias of social mistanasia. Thus, the result was the verification that responses based on human rights, in periods of exception, are more effective. To achieve the objectives of this work, the deductive method was adopted, with a review of documents, doctrine and jurisprudence.
